O conceito de recurso, segundo Barbosa Moreira, \u00e9: \u201cRem\u00e9dio volunt\u00e1rio id\u00f4neo a ensejar, dentro do mesmo processo, a reforma, a invalida\u00e7\u00e3o, o esclarecimento ou a integra\u00e7\u00e3o de decis\u00e3o judicial que se impugna\u201d.<\/p>\n

J\u00e1, a apela\u00e7\u00e3o, o mesmo autor ensina: \u201cA apela\u00e7\u00e3o \u00e9 o principal instrumento por meio do qual atua o princ\u00edpio do duplo grau de jurisdi\u00e7\u00e3o\u201d.<\/p>\n

Recurso de Apela\u00e7\u00e3o \u2013 efeito devolutivo<\/p><\/div>\n

Neste cen\u00e1rio, tem-se que a apela\u00e7\u00e3o, em regra, pode ter dois efeitos, o suspensivo e o devolutivo. Quanto a este \u00faltimo, pode-se apontar algumas caracter\u00edsticas:<\/p>\n

– A extens\u00e3o deve ser a mesma da primeira inst\u00e2ncia, ou seja, os mesmo pedidos formulados no 1\u00ba grau.<\/p>\n

– Apela\u00e7\u00e3o serve a um controle da decis\u00e3o de primeiro grau.<\/p>\n

– Corrige eventuais erros cometidos pelo juiz \u201ca quo\u201d, n\u00e3o pelas partes.<\/p>\n

– H\u00e1 apenas continua\u00e7\u00e3o do estado decis\u00f3rio \u2013 nova decis\u00e3o sobre toda a causa, com base no material apurado no 1\u00ba grau de jurisdi\u00e7\u00e3o.<\/p>\n

– N\u00e3o admite (em regra) novas provas (h\u00e1 exce\u00e7\u00f5es).<\/p>\n

H\u00e1 exce\u00e7\u00f5es da identidade entre material alegado em 1\u00aa e 2\u00aa inst\u00e2ncia?<\/p>\n

– Pode ser alegado fato superveniente<\/p>\n

– Alega\u00e7\u00e3o de fatos j\u00e1 ocorridos, n\u00e3o alegados antes por motivo de for\u00e7a maior<\/p>\n

– Recurso de 3\u00ba prejudicado<\/p>\n

– Demandas cumuladas com pedidos prejudicados ou absorvidos.<\/p>\n

Neste \u00faltimo caso, quando a primeira inst\u00e2ncia n\u00e3o julgou sobre uma mat\u00e9ria, o Tribunal s\u00f3 poder\u00e1 julgar se a causa estiver madura, ou seja, se tiver tido instru\u00e7\u00e3o. Caso contr\u00e1rio, apenas ir\u00e1 anular a senten\u00e7a e devolver para 1\u00aa inst\u00e2ncia (instruir e julgar o processo).<\/p>\n

– A apela\u00e7\u00e3o s\u00f3 devolve ao tribunal a mat\u00e9ria impugnada.<\/p>\n

– A senten\u00e7a \u00e9 sempre dividida em cap\u00edtulos e a devolu\u00e7\u00e3o da mat\u00e9ria se d\u00e1 em rela\u00e7\u00e3o aos cap\u00edtulos da senten\u00e7a que tenham sido objeto do recurso.<\/p>\n

– O apelante n\u00e3o pode pleitear mais do que foi objeto em 1\u00ba grau e, da mesma maneira, o Tribunal n\u00e3o pode seguir adiante e decidir mais do que foi decidido pelo Juiz de primeiro grau.<\/p>\n
